How Ontario overtime is calculated
Overtime pay = (hours over the threshold) × regular rate × 1.5. For salaried employees, the regular hourly rate is the weekly salary divided by the regular hours the salary covers (commonly 40). Pay above 44 hours then follows the same 1.5× rule, unless the employee is exempt under the ESA regulations.

When does overtime start in Ontario?
After 44 hours of work in a work week. Hours over 44 are paid at 1.5 times the regular rate. There is no daily overtime threshold in Ontario, unlike some provinces.
Can overtime be averaged over several weeks?
Only with a written averaging agreement between the employer and employee. Then overtime is calculated on the average hours per week over the agreed period (up to four weeks).
Can I take time off instead of overtime pay?
Yes, with written agreement: 1.5 hours of paid time off for every overtime hour, taken within three months (or twelve with agreement).
Who is exempt from overtime?
Managers and supervisors, many regulated professionals, IT professionals, some agricultural and construction roles, and others listed in the ESA exemptions regulation. Salaried employees are not automatically exempt.
